Terms of Use

This document constitutes a public offer within the meaning of Articles 633 and 641 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce" No. 675-VIII of 03.09.2015. By placing an order on agres.jewelry, you (the Buyer) accept the terms set out below and enter into an electronic sale-purchase contract with the Seller.

01 — Seller

Seller details are to be filled in by the store owner — publishing the exact FOP details on the site is a requirement of Art. 9 of the Law "On Electronic Commerce."

The Seller engages in retail sale of jewelry and related products via agres.jewelry.

02 — Definitions

Site — agres.jewelry and all its subdomains and pages.

Product — jewelry and related items offered on the Site.

Buyer — the individual placing an order on the Site.

Order — a duly completed request by the Buyer to purchase a Product.

03 — Placing an order

The Buyer selects a Product on the Site, adds it to the cart, and completes the order form with name, phone number, email, and shipping address.

Once the order is placed, the Buyer receives confirmation by email and/or phone — this confirmation marks the conclusion of the electronic contract under Art. 11 of the Law "On Electronic Commerce."

The Seller reserves the right to contact the Buyer to clarify order details.

Product availability may be confirmed by the Seller after the order is placed; if a Product is unavailable, the Seller will notify the Buyer and offer an alternative or a refund.

04 — Price and payment

All prices on the Site are quoted in Ukrainian hryvnia and include VAT where applicable.

The Seller reserves the right to change prices on the Site; the price confirmed at the time an order is placed is final for that order.

Payment is made online via Monobank (bank card, Apple Pay, Google Pay) or, where available, cash on delivery. Card details are processed directly by Monobank and never reach the Seller.

After payment, the Buyer receives a fiscal receipt in accordance with Ukrainian tax legislation.

05 — Delivery

Products are delivered via Nova Poshta — to a branch, parcel locker, or courier to the door, depending on the option chosen.

Delivery cost and timing are calculated at checkout and depend on Nova Poshta's rates and the Buyer's location.

Risk of accidental loss or damage to the Product passes to the Buyer once the Product is handed to the carrier, except where damage is caused by the Seller's fault.

The Buyer is encouraged to inspect the Product upon receipt in the presence of a Nova Poshta representative and to file a damage report if any issue is found.

06 — Right of return and exchange

Under the Law of Ukraine "On Protection of Consumer Rights" (as amended by Law No. 3153-IX of 10.06.2023), a consumer who purchases goods remotely has the right, within 14 days of receiving the goods, to withdraw from the purchase without giving a reason — provided the goods retain their original condition, consumer properties, and proof of purchase.

This right, however, does not apply to all goods. The list of quality goods not subject to exchange or return, approved by Resolution of the Cabinet of Ministers of Ukraine No. 172 of 19.03.1994, expressly includes jewelry and other articles made of precious metals, precious and semi-precious stones, and articles of organogenic and semi-precious stones.

If the item you purchased is made of gold, silver, or another precious metal, or contains a precious or semi-precious stone — natural or synthetic — that item is not eligible for return or exchange as long as it is of proper quality, meaning free of manufacturing defects.

This restriction does not apply to costume jewelry made from non-precious materials — alloys, glass, imitation stones, textiles, and the like — where such items are separately listed in the Seller's catalogue: those remain subject to the standard 14-day return right under the Law.

Regardless of material, the right to return or exchange goods of improper quality — with a manufacturing defect not caused by the Buyer — applies in full under the Law "On Protection of Consumer Rights." Warranty period, complaint procedure, and response timelines are set out in "Warranty and quality" below.

The Seller may, at its own discretion, agree to exchange a jewelry item of proper quality, for example for a different size, as a goodwill gesture — this is not a legal obligation.

To initiate a return for goods of improper quality or to clarify details, write to agres.jewelry@gmail.com within a reasonable time of discovering the defect.

07 — Warranty and quality

The Seller warrants that the Product matches the description provided on the Site — metal purity/hallmark, weight, stones, and so on.

If a manufacturing defect is found, the Buyer is entitled to free repair, replacement, or a refund in accordance with the Law "On Protection of Consumer Rights."

The warranty does not cover damage caused by improper use, mechanical impact, contact with chemicals (perfume, cleaning agents, chlorinated or salt water), or ordinary wear and tear.

Quality complaints are accepted at agres.jewelry@gmail.com with a description of the defect and photos of the Product.

08 — Intellectual property

All text, photographs, the logo, Site design, and product images are the intellectual property of the Seller or used under a lawful license. Copying, reproducing, or otherwise using these materials without the Seller's written consent is prohibited.

09 — Liability

The Seller is not liable for delivery delays caused by the carrier, force majeure — including martial law, air-raid alerts, power or communications outages — or circumstances beyond the Seller's reasonable control.

The Buyer is responsible for providing accurate contact details and shipping address; the Seller is not liable for consequences arising from incorrect data provided by the Buyer.

The Seller's liability is limited to the value of the relevant Product, unless otherwise required by law.

10 — Personal data

Processing of the Buyer's personal data is governed by the separate Privacy Policy, which forms an integral part of these Terms.

11 — Governing law and dispute resolution

These Terms are governed by the law of Ukraine. Disputes arising from this contract are resolved through negotiation and, failing agreement, through the courts in accordance with Ukrainian law. Consumers also have the right to contact consumer-protection authorities in their place of residence.

12 — Changes to these Terms

The Seller reserves the right to update these Terms unilaterally. The current version is always published on this page. Orders placed before a change was made remain governed by the Terms in effect at the time the order was placed.
